Invitation to review the proposed changes to the Categorisation criteria for Exchange Participant and review the Rules of placement in the categories

Relying on the public consultation announced by the National Energy Regulatory Council (hereinafter – the Council) regarding the amendment of the Energy Resource Exchange Regulation (hereinafter – the Regulation) and taking into account the comments and proposals from exchange participants on the Proposed changes to the categorisation criteria for Exchange Participants and the Draft Amendment to the Rules of placement in categories of participants, the Energy Resource Exchange operator has prepared a draft amendment to the Rules of Placement in Categories and Reviewing Categories of Participants of the Exchange. The amendment is planned to enter into force on 1 January 2026.

The important changes

1. It is proposed that the criteria for assigning participants to categories and the permitted duration of transactions will be set out in the Regulations to be approved by the Council.

2. the Operator shall assess the reports of the participant-seller on the quantity and quality indicators of biomass approved (including undisputed) and the data provided by the buyers during the previous calendar month. The Operator shall warn the participant and for a repeated violation committed during the warning period or during the application of a previously applied sanction, it shall place the participant in a lower category if the participant:

  • has not delivered more than 15% of the vehicles specified in the ETS coordinated delivery schedule (units);
  • delivered more than 10% of vehicles, which, according to the acts of refusal to accept biomass submitted to the ETS and (or) the Operator, the buyer refused to accept due to non-compliance with the quality requirements established in the biomass purchase and sale agreement or the presence of impermissible impurities (stones, metal, plastic, bark, if it is not permitted according to the technical specification of the product, etc.) (units);
  • delivered more than 1% of vehicles or more than 1 (one) vehicle under the same contract, which, according to the acts of refusal to accept biomass submitted to the ETS and (or) the Operator, the buyer refused to accept due to the use of impermissible raw materials in the production of the biomass product (coated, varnished, painted or otherwise chemically treated wood, wood from construction sites, wood and plastic composites, sewage sludge, herbaceous plant biomass, etc.) (units);
  • has delivered more than 10% of the vehicles to which a discount was applied for ash content exceeding the limits of insignificant error (units);
  • The participant-buyer has been late in paying or security measures were used
